Tagging Someone On Facebook

Maribel Calderon was once married to Gonzales’s brother and got a protection order against Gonzales which prevent her from contacting her former sister-in-law.

In one Facebook post Gonzales called Maribel Calderon stupid  and in another she writes that:

You and your family are sad… You guys have to come stronger than that!! I’m way over you guys but I guess not in ya agenda.

The protection order prohibits Gonzales from, amongst other things, contacting Calderon.Gonzales tried to argue that a Facebook post does not fall under the scope of the protection order that Calderon had obtained against her.  The Westchester County Supreme Court disagreed, finding that:

The order of protection prohibited the defendant from contacting the protected party by electronic or any other means

For contravening the terms of the protection order, ie contacting Calderon, Gonzalez was charged with second-degree criminal contempt which could land her a year in prison. Her legal representatives confirmed that she would not be appealing the order and would be sentenced soon.
